These Terms of Use (“Terms”) govern your access to and use of PromoAI: AI Image Maker (“PromoAI”, “the App”, “we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About PromoAI

PromoAI is an AI-powered image creation and editing app. The App may allow users to generate images from text prompts, edit uploaded images, create product visuals, posters, social media graphics, and other AI-generated images.

Some features may require credits, subscriptions, lifetime access, internet connection, Google Play Billing, Firebase services, or supported AI generation services.

2. Eligibility

You must be legally allowed to use digital services in your country or region. PromoAI is not intended for children under 13. If you are under the age required by law in your country, you may use the App only with permission and supervision from a parent or legal guardian.

You are responsible for ensuring that your use of the App complies with applicable laws and regulations.

3. User Account and Sign-In

PromoAI may create an anonymous Firebase account when you first use the App. You may also choose to sign in with Google to help save your credits, purchase status, subscription access, lifetime access, and generation history across devices.

You are responsible for maintaining access to the Google account used with the App. If you use the App anonymously and later uninstall the App, clear app data, change device, or lose access to your anonymous account, you may lose access to credits, history, or saved outputs linked to that anonymous account.

For purchases, subscriptions, lifetime access, and restore purchase features, Google Sign-In may be required to help protect your access and prevent account loss.

4. Credits, Subscriptions, and Purchases

PromoAI may use a credit-based system. Credits may be required for text-to-image generation, AI image editing, HD output, premium models, or other paid features.

The amount of credits required may vary depending on the feature, image quality, output resolution, model type, or processing cost. We may update credit usage rules from time to time.

PromoAI may offer:

• free starter credits;
• credit packs;
• weekly subscriptions;
• monthly subscriptions;
• monthly plus subscriptions;
• lifetime access;
• other promotional or paid plans.

Purchases are processed through Google Play Billing. We do not process or store your full payment card information.

Important purchase rules

• Credits are not cash and have no cash value.
• Credits cannot be transferred, sold, exchanged, or redeemed for money.
• Unused credits are not automatically refunded.
• Subscription benefits apply only while the subscription is active, unless otherwise stated.
• Lifetime access does not mean unlimited image generation.
• Lifetime access may include specific benefits, such as no watermark and a one-time credit bonus, as described in the App.
• Additional credits may still be required for future generation or editing after included credits are used.

If a refund is approved by Google Play or required by applicable law, we may remove related credits, subscription access, lifetime benefits, generated entitlements, or other benefits connected to the refunded purchase.

5. Free Credits and Abuse Prevention

PromoAI may provide free credits to new users. Free credits are intended only for genuine trial use.

You may not abuse the free credit system by repeatedly reinstalling the App, creating multiple accounts, using automation, exploiting anonymous login, manipulating devices, or attempting to obtain unlimited free generations.

We reserve the right to limit, suspend, revoke, or block access to free credits or App features if we detect abuse, fraud, suspicious activity, or misuse.

6. AI-Generated Content

PromoAI uses AI services to generate or edit images. AI-generated results may be inaccurate, unexpected, imperfect, offensive, or unsuitable for your intended use.

You understand and agree that:

• AI results are generated automatically based on prompts, uploaded images, settings, and AI model behavior.
• We do not guarantee that generated images will be accurate, unique, copyright-free, error-free, or suitable for commercial use.
• You are responsible for reviewing generated images before using, publishing, sharing, selling, or relying on them.
• We are not responsible for how you use, publish, distribute, or monetize generated content.

You should not use generated content in a way that violates laws, platform rules, intellectual property rights, privacy rights, publicity rights, or the rights of others.

7. User Content

You are responsible for all content you submit, including prompts, instructions, uploaded images, edited images, and reports.

By using PromoAI, you confirm that:

• you have the rights or permission to upload any image you submit;
• your prompts and uploaded content do not violate the rights of others;
• your content does not contain illegal, harmful, abusive, or prohibited material;
• your use of generated outputs will comply with applicable laws and policies.

You grant us a limited right to process your prompts, uploaded images, instructions, and generated outputs only as needed to provide the App, operate AI generation/editing features, store history, process reports, secure the service, and improve reliability.

8. Prohibited Uses

You agree not to use PromoAI to create, upload, request, generate, edit, share, or distribute content that:

• is illegal or promotes illegal activity;
• exploits, harms, or sexualizes minors;
• contains non-consensual sexual content or intimate imagery;
• impersonates real people in a misleading or harmful way;
• violates privacy, publicity, copyright, trademark, or other rights;
• creates deceptive, fraudulent, scam, phishing, or misleading content;
• promotes hate, harassment, threats, or violence;
• encourages self-harm, terrorism, extremism, or dangerous activity;
• creates fake official documents, IDs, certificates, currency, or legal/financial documents;
• contains malware, spyware, credential theft, or other cyber abuse;
• attempts to bypass safety systems, filters, credits, billing, or App limitations;
• overloads, attacks, reverse engineers, scrapes, or disrupts the App or backend services.

We may block prompts, reject image generation requests, remove content, suspend access, or take other action if we believe the App is being misused.

9. Image Upload and Editing

When you use image editing features, you may upload or select images from your device. You are responsible for ensuring that you have the legal right to use and edit those images.

You may not upload images containing private, illegal, harmful, abusive, or rights-infringing content. You may not upload images of other people for misleading, harmful, defamatory, exploitative, or non-consensual purposes.

AI image editing may change or alter the original image. We do not guarantee that edited images will preserve all details, identity, product shape, text, logos, colors, or original features.

10. Watermarks and Pro Features

Free users may receive images with watermarks or limited quality. Paid plans may remove watermarks or unlock additional features, depending on the active plan.

You may not remove, hide, crop, bypass, or manipulate watermarks or App restrictions unless your plan allows watermark-free output.

Pro features, HD output, image editing, premium templates, priority generation, or other paid features may change over time depending on service availability, cost, model limitations, and platform requirements.

11. Availability and Service Changes

PromoAI depends on third-party services, including Firebase, Google Play Billing, Google Gemini image generation services, cloud storage, network providers, and device compatibility.

We do not guarantee that the App will always be available, uninterrupted, error-free, fast, or compatible with all devices.

We may modify, suspend, limit, or discontinue any feature at any time, including free credits, pricing, credit usage rules, AI models, image quality options, subscriptions, or lifetime benefits, where reasonably necessary for security, cost control, technical, legal, or business reasons.

12. Refunds and Cancellations

Payments, refunds, cancellations, and subscription management are handled through Google Play according to Google Play policies and applicable law.

You can manage subscriptions through your Google Play account.

Unused credits are not automatically refunded. If Google Play approves a refund, we may revoke the related credits, subscription access, lifetime benefits, or other entitlements.

13. Intellectual Property

PromoAI, including its name, design, interface, code, branding, logos, features, and related materials, is owned by or licensed to the developer and is protected by applicable intellectual property laws.

You may not copy, modify, reverse engineer, distribute, sell, rent, or create derivative works based on the App, except where permitted by law.

You retain responsibility for the prompts, uploaded images, and content you submit. Rights in AI-generated content may depend on applicable law, the rights of third parties, AI service provider terms, and how you use the output. We do not guarantee exclusive ownership or legal clearance of any AI-generated image.

14. Third-Party Services

PromoAI uses third-party services, including but not limited to:

• Google Firebase Authentication;
• Google Firebase Firestore;
• Google Firebase Storage;
• Google Firebase Functions;
• Google Gemini image generation services;
• Google Play Billing;
• Firebase Analytics.

Your use of the App may also be subject to Google’s terms, Google Play policies, Firebase terms, and other third-party service policies.

15. Account Suspension or Termination

We may suspend, restrict, or terminate your access to the App or certain features if we believe that you:

• violate these Terms;
• misuse the App;
• abuse free credits;
• attempt fraud or payment abuse;
• submit prohibited content;
• interfere with App security or operation;
• violate applicable law or third-party rights.

Suspension or termination may result in loss of access to credits, history, generated images, Pro features, or other App data, subject to applicable law and Google Play policies.

16. Disclaimers

PromoAI is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we make no warranties that:

• the App will always work without errors;
• AI-generated images will meet your expectations;
• generated content will be accurate, unique, lawful, or commercially usable;
• uploaded or generated images will always be preserved;
• the App will be available at all times;
• any feature will remain available forever.

You use the App and generated content at your own risk.

17. Limitation of Liability

To the maximum extent permitted by law, Arini Indarti and PromoAI will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, credits, generated content, business opportunity, reputation, or goodwill.

Our total liability for any claim related to the App will be limited to the amount you paid for the App or related purchase giving rise to the claim, unless applicable law requires otherwise.

18. Indemnity

You agree to defend, indemnify, and hold harmless Arini Indarti and PromoAI from any claims, damages, liabilities, losses, costs, or expenses arising from:

• your use of the App;
• your prompts, uploaded images, generated images, or shared content;
• your violation of these Terms;
• your violation of laws or third-party rights;
• your misuse of AI-generated content.

19. Changes to These Terms

We may update these Terms from time to time. If changes are material, we may provide notice in the App or by other reasonable means.

Your continued use of PromoAI after updated Terms become effective means you accept the updated Terms.
